Terms of Service

1. Agreement to these terms

By accessing or using Open Book Clinical (the "Platform"), operated by Auburn Health Pty Ltd (trading as Open Book Clinical) ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

These Terms form a legally binding agreement between you and Auburn Health Pty Ltd (trading as Open Book Clinical). You must be 18 years or older and have legal capacity to enter into contracts to use the Platform.

If you are using the Platform on behalf of an organisation (a clinic, hospital, or other entity), you represent that you have authority to bind that organisation to these Terms.

2. The service

Open Book Clinical is a clinical decision-support platform that aggregates and synthesises evidence from publicly available clinical literature, including Cochrane Reviews, PubMed, NHMRC guidelines, Therapeutic Guidelines, and other Australian clinical resources.

The Platform uses artificial intelligence to process queries and generate responses. These responses are automatically generated and have not been individually reviewed or verified by a clinician or medical professional.

We reserve the right to modify, suspend, or discontinue the Platform (or any part of it) at any time, with or without notice. We will not be liable to you for any modification, suspension, or discontinuation of the Platform.

3. Clinical disclaimer — please read carefully

⚕️ Important clinical notice

Open Book Clinical is a decision-support tool only. It is not a substitute for professional clinical judgement, examination, diagnosis, or treatment. Information provided by the Platform must not be used as the sole basis for any clinical decision.

All clinical decisions remain the sole responsibility of the treating clinician. You must:

  • Apply your own professional clinical judgement to every response
  • Consider individual patient factors, comorbidities, and circumstances
  • Verify currency of evidence — guidelines and evidence bases are updated regularly
  • Comply with your professional registration obligations and scope of practice
  • Not share Platform outputs directly with patients as medical advice

We do not accept any liability for clinical outcomes arising from use of the Platform. If you are uncertain about a clinical decision, consult a colleague, supervisor, or relevant specialist.

4. Accounts and registration

To access the full Platform, you must create an account using a valid email address. You agree to provide accurate, current, and complete information during registration and to keep this information updated.

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at legal@openbook-health.com if you believe your account has been compromised.

You may not share your account credentials with others or allow multiple individuals to use a single account. Team or clinic plans provide separate logins for each clinician.

AHPRA registration numbers entered into the Platform are used solely to power the compliance tracking features of your account. We do not verify AHPRA registration status.

5. Acceptable use

You agree not to use the Platform to:

  • Enter patient names, Medicare numbers, or other individually identifying patient information into search queries
  • Share your account with others not covered by your plan
  • Reproduce, distribute, or sell Platform outputs commercially without our written consent
  • Attempt to access systems, data, or accounts other than your own
  • Reverse engineer, scrape, or extract the Platform's underlying data or models
  • Use the Platform in any way that violates Australian law or your professional registration obligations
  • Impersonate any person or entity or misrepresent your professional qualifications
  • Submit false, misleading, or defamatory content

We reserve the right to suspend or terminate accounts that violate these rules without notice or refund.

6. Payments, subscriptions, and refunds

Paid plans are billed on a recurring monthly basis via Stripe, our payment processor. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.

Free trial: Where a free trial is offered, it will be stated at the time of sign-up. Your payment method will be charged at the end of the trial unless you cancel before it ends.

Cancellation: You may cancel your subscription at any time from your account settings or by emailing us. Cancellation takes effect at the end of the current billing period. You retain access to paid features until that date.

Refunds: We do not offer refunds for partial billing periods. If you cancel mid-month, you will continue to have access until the end of that billing period and will not be charged again. Exceptions may be made at our discretion for technical failures on our part.

Price changes: We may change subscription pricing with 30 days' notice by email. Your continued subscription after the notice period constitutes acceptance of the new pricing.

All prices are in Australian dollars (AUD) and are inclusive of GST where applicable.

7. Intellectual property

All content, design, software, trademarks, and technology on the Platform are owned by or licensed to Auburn Health Pty Ltd (trading as Open Book Clinical). You may not reproduce, modify, or distribute any part of the Platform without our written consent.

The underlying clinical literature and guidelines that the Platform synthesises are owned by their respective publishers (Cochrane, NHMRC, etc.). Platform outputs are AI-generated summaries and are not a substitute for consulting original sources.

Your content: You retain ownership of any content you input into the Platform (such as CPD notes). You grant us a limited licence to process this content to provide the service. See our Privacy Policy for details.

8. Privacy

Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in that policy.

Do not enter patient identifiers (names, dates of birth, Medicare numbers, addresses) into search queries. De-identify all patient information before inputting it.

9. Limitation of liability

To the maximum extent permitted by Australian law, Auburn Health Pty Ltd (trading as Open Book Clinical) and its directors, employees, and contractors will not be liable for:

  • Any clinical decision made by a user based on Platform outputs
  • Errors, omissions, or inaccuracies in AI-generated responses
  • Loss of data, revenue, or profits arising from use of or inability to use the Platform
  • Indirect, consequential, or punitive damages of any kind

Our liability, where it cannot be excluded by law (including under the Australian Consumer Law), is limited to re-supplying the relevant service or the cost of having it re-supplied.

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or condition that cannot lawfully be excluded under the Australian Consumer Law.

10. Termination

You may close your account at any time by contacting us at legal@openbook-health.com. Upon closure, your personal data will be handled in accordance with our Privacy Policy.

We may suspend or terminate your account immediately, without notice or liability, if we reasonably believe you have breached these Terms or engaged in conduct harmful to the Platform, other users, or third parties.

Sections 3 (Clinical disclaimer), 7 (Intellectual property), 9 (Limitation of liability), and 12 (Governing law) survive termination of these Terms.

11. Changes to these terms

We may update these Terms from time to time. When we do, we will update the effective date and, for material changes, notify you by email. Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance of the changes.

If you do not agree to the revised Terms, you must stop using the Platform and cancel any active subscription before the effective date.

12. Governing law

These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising from these Terms or your use of the Platform.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
